Three Couples Sue State Over Policy Prohibiting Same-Sex Couples from Becoming Foster Parents

Posted: Updated:

Three Lincoln couples have filed a lawsuit against the state of Nebraska after being told they could not become foster parents because of a policy from 1995 prohibiting same-sex couples from becoming licensed with the state.

The American Civil Liberties Union, the ACLU of Nebraska and the law firm Sullivan & Cromwell filed the suit Tuesday to strike down the state's policy that bans openly gay people and unrelated, unmarried adults who live together from serving as foster parents.

The ban also prohibits these individuals from adopting children from the foster care system, as individuals must first be licensed as foster parents before adopting children from state custody.

State lawmakers considered a bill earlier this year that would have allowed gay and lesbian couples to serve as foster parents, but that bill failed to advance before the legislative session ended.
