A man convicted of shooting a deputy's car will be tried again after filing a successful appeal.
Earlier in the year a jury found Trent Esch guilty of criminal mischief and using a weapon to commit a felony.
An appeal was filed on his behalf and the Nebraska court of appeals said the trial court made mistakes. The court said the 'Use of a Weapon' conviction doesn't count and ordered a new trial; the criminal mischief conviction will stay.
The court said the new trial will have to re-determine the cost of the damages to the deputy's car.
