  1. Contest Schedule: The Search for the Biggest Kimmel Fans in History! Contest (the "Contest") begins on or about 3/24/14 at 12:01 a.m. Central Time ("CT") and ends on 4/18/14 at 11:59:59 p.m. CT (the "Contest Period"). By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects.
  1. Eligibility: Only legal U.S. residents who are eighteen (18) years of age or older at the time of entry and reside in the KHGI Designated Market Area ("DMA") as determined by Nielsen Media Research Services are eligible to enter. The KHGI DMA covers the following states/counties – Kansas: Phillips, Republic, and Smith counties; Nebraska: Adams, Antelope, Blaine, Boone, Boyd, Brown, Buffalo, Butler, Chase, Clay, Custer, Dawson, Fillmore, Franklin, Frontier, Furnas, Gage, Garfield, Gosper, Greeley, Hall, Hamilton, Harlan, Hayes, Hitchcock, Holt, Howard, Jefferson, Kearney, Keya, Paha, Lancaster, Loup, Merrick, Nance, Nuckolls, Pawnee, Perkins, Phelps, Polk, Red Willow, Rock, Saline, Seward, Sherman, Thayer, Valley, Webster, Wheeler, and York counties.. Approximately 25-30 other ABC television affiliate markets will be conducting their own, separate The Search for the Biggest Kimmel Fans in History! Contest – you may only enter the contest in the affiliate market where your primary residence is located. Employees of Sponsor, Administrator, American Broadcasting Companies, Inc. ("ABC"), Jackhole Industries, Loews Hotels Corporation, each of their respective parent, subsidiary, related and affiliated companies, as well as persons involved in the creation, development or production (including talent and crew) of Jimmy Kimmel Live!, and the immediate family members and household members of all such foregoing individuals, are not eligible to enter the Contest or win a prize. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three (3) months a year, whether related or not.


  1. Contest Entry:

Step 1 (Access Website): Navigate the Internet to ("Website").

Step 2 (Registration): Select the ABC affiliate market DMA in which your primary residence is located from the supplied list of participating markets, and then provide your first and last name, complete mailing address, e-mail address, daytime telephone number and date of birth on the entry form.

Step 3 (Short Essay): On the entry form, submit a short essay 250 words or less in response to the following: "Tell us why YOU are the biggest Jimmy Kimmel fan in history."

Once you have completed the registration and written your short essay, submit your entry by clicking the "enter" button on the Website. In order to submit your entry, you must check the box signifying that you have read and agree to these Official Rules and the Website's Terms of Use, available at Without the short essay, entry will be deemed incomplete and will be disqualified. All entries must be received by 11:59:59 p.m. CT on 4/18/14. Once submitted, entry cannot be modified or supplemented by entrant.

An "Entry" consists of an individual's registration information AND SHORT ESSAY As DESCRIBED ABOVE. Partial or incomplete/piecemeal submissions (e.g., submission of registration without short essay; submission of short essay without registration) will NOT be accepted.

Personal information collected in connection with this Contest will be treated in accordance with ABC's Privacy Policy, accessible at You may be asked to consent to receive promotional and reminder e-mails from Sponsor or third parties. Consenting to receive promotional and/or reminder e-mails is optional and does not have to be agreed upon in order to be eligible to participate in the Contest.

Limit one (1) Entry per person during the Contest Period. Multiple entries in excess of this limitation or mass entry attempts will result in disqualification of all entries by such person. Entries must be manually key-stroked; use of automated entry devices or programs is prohibited. In the event of a dispute over who submitted an online entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail account identified on the online entry form. The authorized account holder is deemed to be the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or online organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Without limitation of the Terms of Use posted on the Website, by submitting an Entry, each entrant grants Sponsor, ABC, Jackhole Industries and each of their respective designees a perpetual, non-exclusive, irrevocable, fully-paid, royalty-free, sub-licensable and transferable (in whole or part) worldwide license to use, reproduce, transmit, display, exhibit, distribute, create derivative works based upon, publicly perform and otherwise exploit the Entry, in whole or in part, in all media formats and channels now known or hereafter devised for any and all purposes including entertainment, news, advertising, promotional, marketing, publicity, trade or commercial purposes, all without further notice to the entrant, with or without attribution, and without the requirement of any permission from or payment to the entrant or to any other person or entity.

Without limitation of the Terms of Use posted on the Website, Entrant further expressly acknowledges that Sponsor, ABC and Jackhole Industries do not owe him/her a duty of confidence (or fiduciary duty or the like) with regard to his/her short essay and that Sponsor, ABC and Jackhole Industries each have wide access to ideas, stories and other literary/artistic materials submitted to it from outside sources or being developed by its own employees and that such ideas/stories/photos/designs/recipes/literary/artistic materials may be competitive with, similar to (or even identical to) the short essay submitted by entrant and that Sponsor, ABC and Jackhole Industries shall have no liability to entrant or any third party in conjunction therewith.

Entries may not contain, and Sponsor, in its sole discretion, may disqualify any Entry that contains any content that: violates or infringes any right of any third party, including but not limited to intellectual property rights; is defamatory, slanderous, libelous, scandalous or obscene; includes reference to any individuals (other than the entrant or any talent on Jimmy Kimmel Live!) unless entrant has first obtained the consent of any named/depicted/described person as set forth herein; is sexually explicit or suggestive; is derogatory of any ethnic, racial, gender, religious, professional or age group; is profane or pornographic; or is otherwise inappropriate, objectionable, or unsuitable for the uses contemplated in these Official Rules, as determined by Sponsor in its sole discretion.

If an Entry is unable to be viewed by the Sponsor for any reason whatsoever, that Entry shall be disqualified and Sponsor and its designees will not be responsible or liable for any such inability.

 Short Essay must be the original work of the entrant (DO NOT COPY OTHERS' WORKS, IN WHOLE OR IN PART), may not have been previously published or distributed through any media channel, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. By submitting an Entry, entrant warrants and represents that he/she and any persons who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from you at any time. Failure to provide such proof, if requested, may result in your disqualification, at Sponsor's sole discretion.


  1. Judging: Administrator will review and judge all eligible Entries received and recorded during the Entry Period based on the following equally weighted criteria: quality and persuasiveness of short essay; suitability for promotional purposes of short essay; and creativity/originality of short essay. The Entry that receives the highest score will be deemed the winner. In the event of a tie, the Entry from among all such tied entries with the higher/highest score in the "quality and persuasiveness of short essay" criterion will be deemed the winner. Decisions of the Administrator are final and binding in all respects.


  1. Winner Notification: The potential winner will be notified via email/phone on or about the third business day following the conclusion of the Entry Period. Failure to respond to the initial verification e-mail within seventy-two (72) hours after notification or return of e-mail notification as undeliverable after two (2) attempts will result in disqualification. Potential winner will be required to sign and return, within seventy-two (72) hours of notification, an Affidavit of Eligibility, Release and Indemnification, and a Publicity Release where allowed by law. If the Affidavit of Eligibility, Release and Indemnification and Publicity Release (where allowed by law) are not returned to Sponsor within the specified time period, potential winner may be disqualified. If a potential winner is disqualified for any reason, potential winner's prize will be forfeited without compensation of any kind and the entrant with the next highest overall score using the judging criteria above will be deemed the winner (time permitting).


  1. Prize and Approximate Retail Value ("ARV"):

 Grand Prize (1 winner): One (1) Grand Prize: Two (2) admission tickets to a live taping of an episode of Jimmy Kimmel Live! (the "Show"), in Hollywood, California. Location of Show taping is subject to change. The Grand Prize also includes: two (2) nights' hotel accommodation (one room, double occupancy) at the Loews Hollywood Hotel and round-trip, coach-class air transportation for the winner and one (1) guest from Lincoln, NE to Los Angeles, CA. There is no retail value associated with the live taping portion of the Grand Prize. ARV: $3,000.00.

 Grand Prize trip must be completed by December 31, 2014. Grand Prize winner must provide Sponsor with three (3) possible travel dates with at least six (6) weeks advance notice prior to the earliest potential date of departure; however, Sponsor's decision as to actual travel dates is final and binding. Once travel is booked, travel dates cannot be changed unless by Sponsor in its sole discretion. If winner is unable to travel once the travel dates are booked, the prize will be forfeited in its entirety. Actual final value of a Grand Prize may vary depending upon point of departure and fare fluctuations; and, under no circumstances will winner receive the difference between ARV and actual final value of Grand Prize trip in cash. Redemption of room subject to availability at the time of booking. Blackout dates apply. Accommodations are for two (2) adults sharing one (1) room. Grand Prize trip is for the winner and his/her guest, is non-transferable and cannot be extended beyond the date set forth above. Grand Prize winner is solely responsible for all other expenses not specified herein, including but not limited to: roundtrip transportation between winner's residence and departure airport, roundtrip transportation between Los Angeles airport and hotel, and roundtrip transportation between hotel and the Show, as well as meals, tips, taxes and hotel incidentals.

 All federal, state and/or local taxes are the sole responsibility of the Grand Prize Winner, who will receive an IRS Form 1099 reflecting the actual final retail value of the Grand Prize.

 The winner's travel companion must be at least eighteen (18) years of age or older. Winner and his or her guest must travel together on the same itinerary and possess all required travel documents, including visas and valid passports, if and as applicable. Air transportation tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes.

 Grand Prize winner and/or winner's guest must follow all instructions of Sponsor relative to the Grand Prize trip. Should Grand Prize winner and/or guest fail to adhere to any such instructions or engage in unruly, obnoxious, illegal, threatening, or otherwise inappropriate behavior (as determined by Sponsor in its sole discretion), Sponsor reserves the right, without further notice or warning, to terminate the trip or other applicable experience early, in whole or in part, and send Grand Prize winner and/or winner's travel guest home and/or take other actions as Sponsor deems appropriate in its sole discretion without any liability or other obligation to winner or guest. Winner and guest must comply with the Show's rules and regulations at all times. Failure to do so may result in forfeiture of the prize. Show taping is subject to, and Sponsor is not responsible for, changes to production schedule, production exigencies or delays, postponements or cancellation of the Show. If winner is unable to travel during the dates designated by Sponsor, the prize will be forfeited in its entirety and Sponsor will have no further obligations to the Winner. In the event the prize winner is able to participate in the trip during the dates designated by Sponsor but the Show taping does not or cannot take place as scheduled or at all, for reasons including but not limited to scheduling conflicts, cancellations, postponement, location changes, an event of force majeure, or for any other reason, then the Sponsor reserves the right to award the remainder of the prize with no further obligation to the winner. Without limiting the foregoing, no cash alternative or prize substitutions will be allowed, except Sponsor reserves the right to substitute prize(s) of comparable value if a prize listed or any portion thereof is unavailable for any reason.


  1. General Conditions and Limitations of Liability: Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor and its agencies are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Contest (in whole or in part) is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, governmental regulation or any other causes beyond Sponsor's control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to terminate, modify or suspend the Contest. In such event, Sponsor reserves the right to conduct the Contest and award the Prize in a manner which is fair, appropriate and consistent with these Official Rules, as determined by Sponsor in its sole discretion. Notice of termination/modification/suspension of Contest will be posted on the Website. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, entries (including answers to Short Essays); or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from participation in or downloading any materials from this Contest.


 By participating in this Contest, each entrant agrees: (a) to be bound by and abide by these Official Rules and the decisions of Sponsor and Administrator, which shall be final and binding in all respects; (b) to furnish Sponsor with executed copies of any documents required by Sponsor in order to be confirmed as the Prize Winner, including without limitation, an affidavit of eligibility/liability/publicity release, as set forth above; and (c) to release and discharge Sponsor, Administrator, American Broadcasting Companies, Inc., Loews Hotels Corporation, Facebook, Inc., each of their respective parent, subsidiary, affiliated, related and successor companies, advertising and promotion agencies, and each of the foregoing entities' respective officers, directors, agents, shareholders, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all injuries, liability, losses and damages of any kind to persons (including without limitation, death and serious bodily injury) or property resulting, in whole or in part, directly or indirectly, from entrant's participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of prize (or portion thereof) (including any travel or activity related thereto), the substitution of the prize (or any portion thereof) in accordance with the Official Rules or the Released Parties' use of any of the rights granted in the Official Rules. Without limiting the generality of the foregoing, by participating in the Contest, each entrant further agrees to release and hold harmless each of the Released Parties for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind; (3) unauthorized human intervention in any part of the entry process or the Contest; or (4) technical or human error which may occur in the administration of the Contest or the processing of entries.

Disputes; Arbitration/Choice Of Law: Except where prohibited, entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or the award of prize/determination of Prize Winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Nebraska, without regard for conflicts of law doctrine of Nebraska or any other jurisdiction, and all proceedings shall take place in the City of Kearney, County of Buffalo.
